1. Acceptance of Terms

By downloading, accessing or using the MH4All mobile application or website (collectively "the Platform"), you acknowledge that you:

  • Have read, understood and agreed to these Terms & Conditions in full.
  • Understand that the Platform provides wellness and educational information only, and does not constitute medical advice or treatment.

If you do not agree to these Terms, you must not use the Platform.

2. Eligibility

The Platform is available only to persons:

  • Aged 18 years or older;
  • Capable of entering into legally binding agreements; and
  • Resident in jurisdictions where such use is lawful.

The Platform is not intended for children, emergencies, or users requiring urgent medical care.

3. Nature of the Platform

MH4All is a digital wellness-support and educational platform. It is not a medical practice, hospital or healthcare provider.

The Platform:

  • Does not provide emergency medical services;
  • Does not diagnose, treat, cure or prevent any disease or medical condition;
  • Does not replace consultation with a qualified healthcare professional; and
  • Does not guarantee any health outcome.

All information, laboratory interpretations, nutritional guidance and supplement recommendations provided through the Platform are for educational and general wellness purposes only.

4. User Registration and Account

When registering on the Platform, users are required to provide accurate personal information including name, date of birth, gender, height, weight, contact details and health-related information. Certain biometric calculations such as Body Mass Index (BMI) may be generated automatically within the Platform.

Users are responsible for:

  • Providing accurate and truthful information at registration and during use;
  • Keeping login credentials secure and confidential; and
  • Notifying us promptly of any unauthorised use of their account.

5. Laboratory Information and AMPATH Integration

Laboratory results may be imported into the Platform from participating laboratories, including Ampath Laboratories (Pty) Ltd, pursuant to a Data Processing and Integration Agreement concluded between MH4All and Ampath, and in accordance with section 32 of the Protection of Personal Information Act 4 of 2013 ("POPIA").

By authorising the import of your laboratory results, you:

  • Consent to your health information being processed by MH4All as operator, in accordance with the AMPATH integration agreement;
  • Acknowledge that laboratory results imported to the Platform will be used to generate wellness-oriented insights and supplement guidance; and
  • Understand that interpretive ranges used within the Platform may differ from standard laboratory reference ranges and are intended for wellness-support purposes only.

MH4All does not guarantee laboratory accuracy, uninterrupted integrations or availability of third-party laboratory services. Users are advised to consult a qualified healthcare professional regarding any abnormal results.

Please note: Blood tests must be performed while you are in good health. Do not have blood drawn if you are ill with any infection, flu or inflammatory condition. Wait at least 7 days after recovery before testing. Do not have blood drawn if you have recently used cortisone; wait at least 7 days after ceasing cortisone. Testing must be performed in a fasting state — no food or beverages other than water after 22h00 the night before, with blood drawn between 08h00 and 10h00 the following morning.

6. Nutritional Supplement Guidance

Supplement recommendations provided through the Platform:

  • Are generated based on wellness-oriented interpretation of laboratory markers, lifestyle information and user-provided health data;
  • Are intended to support general wellbeing and nutritional balance;
  • Are not intended to diagnose, treat, cure or prevent any disease; and
  • Do not guarantee outcomes or individual effectiveness, as responses to supplements vary between individuals.

IMPORTANT: It is your sole responsibility to ensure that any supplement recommended through this Platform does not:

  • Interact negatively with any chronic prescription medication you are taking;
  • Aggravate any existing chronic illness or medical condition; or
  • Trigger any known allergy or sensitivity.

Users who are pregnant, breastfeeding, have chronic medical conditions, or take chronic prescription medication must consult a qualified healthcare professional before taking any supplement recommended through this Platform. MH4All and Dr Kevin Scheepers Inc. expressly disclaim any liability for adverse reactions arising from failure to disclose relevant medical history or to seek professional advice before commencing supplementation.

7. Nutritional and Exercise Guidance

Nutritional information and meal planning content provided through the Platform is for general educational purposes only and should not be interpreted as individualised medical nutrition therapy unless specifically provided by a qualified healthcare professional.

Exercise guidance is general in nature. Users with existing health conditions, injuries or concerns should consult a healthcare professional before commencing any exercise programme.

8. Purchases and Payments

Supplement products may be purchased through an integrated third-party e-commerce platform (currently Shopify). All purchases are subject to:

  • Product availability;
  • Applicable delivery terms and conditions;
  • The payment provider's terms; and
  • Relevant South African consumer protection laws.

Users agree to provide accurate payment information. MH4All reserves the right to refuse or cancel orders where necessary.

9. Refunds

Refunds or replacements may be considered where:

  • Incorrect products were supplied;
  • Products are defective or damaged; or
  • Verified fulfilment errors occurred.

Refund requests may require supporting evidence. Consumer rights under the Consumer Protection Act 68 of 2008 and other applicable South African legislation remain unaffected.

10. Fees

MH4All reserves the right to introduce a once-off registration or consultation fee for access to the Platform's personalised wellness services. Users will be notified of any fees prior to being charged and will have the option to accept or decline before any payment is processed.

11. Intellectual Property

All content, branding, algorithms, graphics, text and platform material remain the intellectual property of MH4All and/or its licensors. Users may not reproduce, distribute, modify or commercially exploit Platform content without prior written permission.

12. Prohibited Conduct

Users may not:

  • Misuse the Platform or use it for unlawful purposes;
  • Interfere with Platform security or attempt unauthorised access;
  • Transmit malicious software or harmful code;
  • Scrape, harvest or extract Platform data; or
  • Impersonate any person or entity.

13. Platform Availability

We do not guarantee uninterrupted Platform availability. Maintenance, updates, laboratory integration downtime or technical failures may temporarily affect access to or functionality of the Platform.

14. Limitation of Liability

To the fullest extent permitted by South African law, MH4All, Managed Health 4 All (Pty) Ltd, Dr Kevin Scheepers Inc., their employees, contractors and affiliates shall not be liable for:

  • Any indirect, consequential or special loss or damage;
  • Loss arising from reliance on wellness information or supplement recommendations;
  • Adverse reactions to supplements, including those arising from undisclosed medication or medical history;
  • Inaccuracies in laboratory results or third-party data;
  • Failure or unavailability of third-party services; or
  • Interruption or discontinuation of Platform services.

Users use the Platform at their own risk. Nothing in these Terms excludes liability where such exclusion is unlawful under applicable South African law.

15. Indemnity

Users indemnify MH4All and Dr Kevin Scheepers Inc. against all claims, losses, damages, costs and expenses (including legal costs) arising from:

  • Misuse of the Platform;
  • Breach of these Terms;
  • Failure to disclose relevant medical information; or
  • Unlawful or negligent conduct by the user.

16. Suspension or Termination

MH4All may suspend or terminate user accounts for breach of these Terms, unlawful activity, misuse of the Platform, or security concerns.

17. Changes to Terms

We reserve the right to amend these Terms at any time. Continued use of the Platform following publication of amended Terms constitutes acceptance of the revised Terms.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the courts of Johannesburg, South Africa.
